These Terms of Service ("Terms") govern your access to and use of the DailySite mobile application and related services (collectively, the "App") provided by Boson Technologies Inc. ("we," "our," or "us"). By creating an account or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization. By using the App, you represent and warrant that you meet these requirements.

2. Account Registration

To access the App's features, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at info@dailysite.app if you suspect unauthorized use of your account.

3. Subscription Plans and Billing

DailySite offers free and paid subscription plans. By selecting a paid plan, you authorize us to charge your payment method on a recurring basis at the rates disclosed at the time of purchase. All fees are non-refundable except as required by applicable law or as expressly stated in these Terms. We reserve the right to modify pricing with reasonable prior notice.

4. Acceptable Use

You agree to use the App only for lawful purposes and in compliance with all applicable laws and regulations. You must not:

Upload or transmit content that is unlawful, defamatory, or infringes any third-party rights.
Attempt to gain unauthorized access to any part of the App or its related systems.
Use the App to transmit spam, malware, or any other harmful or disruptive content.
Reverse-engineer, decompile, or disassemble any portion of the App.
Resell or sublicense access to the App without our prior written consent.

5. Your Content

You retain ownership of all content you submit through the App, including project data, photos, voice recordings, reports, invoices, and estimates ("Your Content"). By submitting Your Content, you grant us a limited, non-exclusive, royalty-free license to store, process, and display it solely for the purpose of providing the App's services to you. We will never sell Your Content to third parties.

6. AI-Generated Content

The App uses artificial intelligence to assist in generating field reports and other content based on your inputs. AI-generated output is provided as a convenience tool and may not always be accurate or complete. You are solely responsible for reviewing, verifying, and approving any AI-generated content before sharing it with clients or third parties.

7. Intellectual Property

All rights, title, and interest in the App — including its software, design, trademarks, and content (excluding Your Content) — are owned by Boson Technologies Inc. or its licensors. Nothing in these Terms grants you any right to use our trademarks, trade names, or other proprietary materials without our prior written approval.

8. Termination

Either party may terminate these Terms at any time. You may close your account through the App settings or by contacting us. We may suspend or terminate your account if you breach these Terms or if we discontinue the App. Upon termination, your right to use the App ceases immediately. We will delete or anonymize your data within 30 days of account closure, except where retention is required by law.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Boson Technologies Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App — even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, where appropriate, notify you via email or in-app notice. Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
